Terms of Service

  1. These Terms of Service (hereinafter referred to as the "Terms") are established for users of the online ticketing service (hereinafter referred to as “Users”) in the operation of which the public interest incorporated foundation Fukutake Foundation (hereinafter referred to as "Fukutake Foundation") has been engaged (hereinafter referred to as the "Service"). In using this Service, users shall be deemed to have consented to the Terms.
Article 1 (Use of Service)
  1. When using this Service, Users shall observe general manners and morals, and technical rules for the Internet.
Article 2 (Preparation of Use Environment)
  1. This Service is aimed at those who have made the correct settings for language (to display both English and Japanese characters), e-mail, and other configurations. Fukutake Foundation will not be responsible for any and all operations or their effects that are caused by anyone not satisfying the aforementioned conditions. In addition, Fukutake Foundation will not be responsible for any and all effects resulting from the improper operation of this Service by Users satisfying the conditions, such as improper OS installation and use of software, and problems in the communication environment.
Article 3 (Application and Modification of Terms)
  1. Users shall be deemed to have consented to the Terms. Fukutake Foundation shall be entitled to modify the Terms without prior notice, and Users shall confirm the Terms whenever such modification is made. The modified Terms shall be valid at the time of display on this page.
  2. This Service will be provided by Fukutake Foundation using the online ticketing system owned and operated by PIA Corporation (hereinafter referred to as "PIA") as one of the contractors involved in ticket sales (hereinafter referred to as "Contractors"). Users shall acknowledge that Fukutake Foundation outsources to Contractors the relevant services to provide this Service in whole or in part, and provides personal information on Users to Contractors to the extent necessary for such services.
Article 4 (Purpose of Use of Personal Information)
  1. Fukutake Foundation shall be entitled to use personal information provided by the Users and specific information about the User (including such information as his/her preferences) for the following purposes. When using personal information for any purpose other than the following purposes, Fukutake Foundation shall formally notify the Users of the purpose and obtain approval from the Users.
    1. Sale and provision of tickets handled by Fukutake Foundation (including, but not limited to, taking orders, settling payments, and arranging exchange on the day);
    2. Services incidental to the preceding item a. (including, but not limited to, informing Users about the change, cancellation, or additional or next sale of tickets, or about a performance, by e-mail, mail, or phone call, and contacting Users for confirmation deemed necessary in the course of providing services);
    3. Operating activities and sales promotion, such as information guidance on Fukutake Foundation's services;
    4. User support for Fukutake Foundation's services (including, but not limited to, dealing with inquiries)
    5. Preparation of statistics collected in a manner making it impossible to identify or specify individuals, and marketing analysis using the statistics, for reference for operating activities and the development of new services; and
    6. Use and recording of access information (on the Internet, via mobile sites, by telephone, etc.) to operate and manage systems, and deal with inquiries.
Article 5 (Provision of User Information to Third Parties)
  1. Fukutake Foundation shall not disclose to any third parties information that it has come to know in the course of the use of this Service without justifiable reasons, except in the case where it falls under any of the following items:
    1. Users have agreed to the disclosure of personal information including, but not limited to name, address, phone number, gender, age, and e-mail address;
    2. Fukutake Foundation discloses statistical information collected to understand the usage trends of this Service, after processing such statistical information into a format whereby no particular User is identifiable;
    3. Users infringe, or are likely to infringe copyrights, property rights, privacy, reputation, faith, or other rights of other users, third parties, or Fukutake Foundation;
    4. In addition to what is listed in the preceding item, users cause, or are likely to cause a disadvantage, or damage to other users, third parties, or Fukutake Foundation;
    5. The disclosure of information is permitted by legislation;
    6. The disclosure of information is required by legislation;
    7. The disclosure of information is requested by a public agency such as the police for a criminal investigation; or
    8. The disclosure of information is otherwise necessary for the operation of this Service.
Article 6 (Sales Method)
  1. Fukutake Foundation may restrict the number of tickets to be sold or sales method, as necessary.
Article 7 (Ticket Sales Service)
  1. In using this Service, tickets to be purchased by Users shall be those handled in the online computer system of PIA (excluding some tickets), in addition to tickets entrusted for sale under this service from Fukutake Foundation.
Article 8 (Conclusion of Purchase Agreement)
  1. Users shall make a purchase offer in accordance with the prescribed procedure, and in principle the purchase agreement shall be concluded upon the completion of such procedure.
  2. After the completion of the purchase procedure, PIA will supplementarily send an e-mail of purchase confirmation to the e-mail address that was entered by the relevant User; provided, however, that Fukutake Foundation shall be in no way responsible for the failure of e-mail delivery due to entry of incorrect information for the e-mail address, illegible garbled characters therein, or any other defect in the details of the purchase offer, or for any error with e-mail delivery including undelivered emails, mistaken delivery, delay in delivery, or rejection of the e-mail.
Article 9 (Payment of Costs)
  1. When purchasing tickets, Users shall pay the ticket cost at the time of purchase, as well as necessary fees for the service to be used, such as the special sales charge, system use fee, and fees related to payment, as a service charge prescribed by Fukutake Foundation.
  2. If no payment is arranged by Users despite the conclusion of the purchase agreement, PIA may terminate the agreement upon expiration of the payment due date prescribed by Fukutake Foundation, and refuse the Users access to Fukutake Foundation's service thereafter.
  3. Fukutake Foundation shall be entitled to add or change each charge or fee, and change the payment method, by notifying Users thereof in advance in a manner as determined appropriate by Fukutake Foundation.
Article 10 (Delivery of Tickets)
  1. Ticket delivery after the conclusion of the purchase agreement shall be made by the means specified by Fukutake Foundation, and Users shall select such means at the time of making a purchase offer. Fukutake Foundation may place restrictions on the delivery method as necessary.
  2. In the event that a ticket is not received for reasons attributable to the User, Fukutake Foundation shall refund none of the ticket cost, service charge prescribed by Fukutake Foundation, fees related to payment and ticket delivery, or any other charges and fees.
Article 11 (Refusal of Sales and Delivery)
  1. Fukutake Foundation may refuse ticket sales or delivery to a User in the case where the User falls under any of the following items:
    1. Submitting a false statement in the items prescribed by Fukutake Foundation, or failure to submit a necessary statement;
    2. Causing a nuisance to other Users or third parties, or any attempt to interfere with the smooth conduct of Fukutake Foundation's sales activities;
    3. Failure to perform the prescribed procedure within the period notified by Fukutake Foundation;
    4. Failure to follow the prescribed purchase method; or
    5. Committing any other act in violation of the Terms.
  2. Fukutake Foundation may claim compensation against the relevant User for any damage caused to Fukutake Foundation in connection with any event listed in the preceding paragraph.
Article 12 (Replacement and Change of Tickets, Cooling-off)
  1. Any ticket for which the purchase agreement has been concluded shall not be replaced, changed, or cancelled for any reason whatsoever. Furthermore, a cooling-off period shall not apply.
Article 13 (Loss and Theft)
  1. Fukutake Foundation will not reissue tickets under any circumstances (including, but not limited to, lost, stolen, or damaged tickets).
Article 14 (Refund on Tickets)
  1. Fukutake Foundation shall provide notice to Users about the cancellation of events.
  2. Any refund shall be issued within the refund period predetermined for each event in the manner prescribed by Fukutake Foundation, and in no way shall be issued if the refund period has expired.
  3. The refund shall be limited to the amount of the ticket cost, system use fee, ticketing charge, and/or special sales charge, and the refund of a payment fee, service fee, transportation, accommodation, and communication costs, and any other charge of a similar nature shall not be issued. Users acknowledge that there may be cases where it takes three to four weeks for Fukutake Foundation to issue the refund, and shall provide their prior consent thereto.
Article 15 (Termination and Resumption of Sales)
  1. Fukutake Foundation will terminate the ticket sales for each individual event, even during its sales period, when the number of tickets sold has reached the predetermined capacity; provided, however, that additional sales may be resumed according to Fukutake Foundation's decision.
Article 16 (Refusal of Use)
  1. Fukutake Foundation may refuse Users access to this Service, such as Users who commit a nuisance or inconvenience to third parties, any act likely to interfere with Fukutake Foundation's service, the acts set forth in Article 18 of the Terms, or any other act determined inappropriate by Fukutake Foundation.
Article 17 (Prohibited Matters)
  1. Users shall not commit any of the acts listed below while using this Service. If such acts are discovered, Fukutake Foundation may, at its discretion, make a ticket purchased by the relevant User invalid, or not permit a refund for such ticket or admission into a performance hall therewith. In the case where the User is already in the hall, said User may be ordered to leave.
    1. Infringement or potential infringement of copyrights, trademark rights, property rights, privacy, portrait rights, reputation, faith, or other rights of third parties or Fukutake Foundation;
    2. Any act causing or likely to cause inconvenience or damage to third parties or Fukutake Foundation;
    3. Slander toward other Users, third parties, or Fukutake Foundation;
    4. Offenses or potential offenses against public order and morality, or provision to other Users or third parties of information contrary to public order and morality;
    5. Criminal acts, acts incidental thereto, or potential acts thereof;
    6. Any election campaign or activity equivalent thereto, whether or not during an election period;
    7. Any activity in relation to sexual mores, religion, or politics;
    8. Any act for profit, or for the purpose of the preparation thereof, through or in connection with this Service without Fukutake Foundation's approval;
    9. Any act interfering with the smooth operation of this Service, or likely to otherwise interfere with this Service;
    10. The use or provision of any harmful program including, but not limited to, a computer virus, through or in connection with this Service;
    11. The use of software performing automatic input or any other function of a similar nature, or any other attempt to use this Service in an unusual manner deemed inappropriate by Fukutake Foundation;
    12. Any attempt to gain unauthorized access to other computer systems or networks connected to this Service;
    13. Any act in violation of, or likely to violate, laws and regulations;
    14. The resale or provision for resale to third parties of tickets purchased from Fukutake Foundation for profit;
    15. The resale or attempted resale of tickets, for an amount over the ticket value, or via an auction or online auction; or
    16. Any other act determined inappropriate by Fukutake Foundation.
Article 18 (Copyrights)
  1. Users shall not be allowed to use information or files provided through this Service beyond the scope of the private use permitted by Copyright Law without the authorization of the person entitled to the information or files, in any manner whatsoever.
Article 19 (Exemption from Responsibility regarding Tickets)
  1. Fukutake Foundation will not be responsible for the sale of tickets other than those directly purchased from the Service.
  2. Fukutake Foundation shall in no way be responsible for damage caused to any User or third parties as a result of significant delay or failure by this service in determining whether or not an offer to purchase or the purchase of a ticket is made, or in giving notice thereof, due to events such as heavy traffic in any communication line, or an unexpected error in any computer system.
Article 20 (Service Cessation, Discontinuation, Change, etc.)
  1. Fukutake Foundation shall be entitled to cease, discontinue, change, suspend, abolish, or postpone this Service in any event falling under any of the following items:
    1. Regular or emergency maintenance of any system for this Service;
    2. Circumstances under which it is not possible to provide this service in a usual manner, such as war, rebellion, riot, labor dispute, earthquake, volcanic eruption, flood, tsunami, fire, blackout, or any other emergency;
    3. Cessation, discontinuation, change or any other act of a similar nature of the services by communication carriers; or
    4. Any other temporary interruption in any equipment or system that Fukutake Foundation determines necessary for the operation of this Service.
  2. Fukutake Foundation shall assume no responsibility to Users for the cessation, discontinuation, change, suspension, abolition, or postponement of this Service under the preceding paragraph.
Article 21 (Disclaimers)
  1. Fukutake Foundation shall be in no way responsible for the damage caused to any User or third parties as a result of the provision of various types of information about or otherwise in connection with this Service, except when such damage is caused with the intention or gross negligence of Fukutake Foundation. In addition, this Service shall be used at the full responsibility of Users, and with the consent and under the responsibility of the relevant statutory agents including, but not limited to, a User’s parents when said User is a minor.
  2. Fukutake Foundation will process personal information entered and sent by Users upon the use of this Service, including, but not limited to, the encryption thereof, to strictly control and pay careful attention to such personal information; provided, however, that no guarantee shall be made to completely prevent leaks, loss, and falsification by others, or other misconduct in relation to information.
  3. Fukutake Foundation will not guarantee in any way the safety, accuracy, certainty, usability, timeliness, fitness for purpose, legitimacy, morality, or any other nature of the content of this Service, information and services provided through this Service, or information and other data that Users obtain through e-mails or other messages sent by this Service or Fukutake Foundation.
  4. Fukutake Foundation has no relationship with any and all information, services, and other data contained in each site linked from this Service, and shall in no way be responsible therefor.
  5. Fukutake Foundation shall not guarantee that the number of tickets or quantity of other goods or services sold through this Service will always satisfy User purchase requirements, or that any descriptions printed on tickets or other goods sold through this Service are true and fair (including whether the description will meet the purpose of the ticket or goods).
  6. Fukutake Foundation shall be responsible for the matters that Fukutake Foundation communicates to any User at the contact details registered by the relevant User at the time of purchase, and not for any other matter arising in connection with this Service.
  7. Fukutake Foundation shall not be responsible for any damage caused to third parties as a result of any User action.
Article 22 (Changes to Service)
  1. Fukutake Foundation may make changes to any system or the details of this Service without prior notice when determining it necessary for the operation thereof.
Article 23 (Governing Law)
  1. The laws of Japan shall apply to any matter relating to the establishment, execution, and interpretation of the Terms.
Article 24 (United Nations Convention on Contracts for the International Sales of Goods (1980))
  1. United Nations Convention on Contracts for the International Sales of Goods (1980) shall not apply to any sale, purchase or any other arrangement under this Service.
Article 25 (Jurisdiction)
  1. Disputes arising between any User and Fukutake Foundation in connection with this Service shall be settled through consultation between the parties in good faith.
  2. All disputes, controversies or differences which may arise between the parties hereto, out of or in relation to or in connection with this Service shall be finally settled by arbitration in Tokyo, in accordance with the Commercial Arbitration Rules of The Japan Commercial Arbitration Association.

Supplementary Provision: The Terms shall become effective on 02/08, 2013 (Japan Standard Time).
